Psychiatrist, lawyer convicted in Anna Nicole Smith case

LOS ANGELES – 2010 The key people in Anna Nicole Smith’s life, those who she believed had her back--her psychiatrist Khristine Eroshevich, and her companion Howard K. Stern, an attorney, were convicted of conspiracy in connection with obtaining drugs for the reality star and Playboy model before her death in 2007.
“This case illustrates the problem of the overuse of prescription medicine in today’s society,” he added. “Medical professionals have a responsibility to ensure that the strict ethical guidelines of their profession are followed in prescribing medicine as part of the care of their patients.”

The jury convicted Khristine Eroshevich, 62, the psychiatrist, and Howard K. Stern, 41, Smith’s companion, of two counts of conspiracy to commit the crimes of obtaining a controlled substance by false name or address, and issuing a prescription that is false or fictitious. The time period covered by the counts was from June 2004 until February 2007 when Smith died in Florida of a drug overdose. The jury failed to reach a consensus on the other allegations in the conspiracy counts, including prescribing, administering and dispensing controlled substances to an addict; unlawfully prescribing a controlled substance; issuing a prescription that is false or fictitious; and violating the state Business and Professions Code.


Eroshevich also was convicted of one count each of obtaining a prescription of opiates by fraud, deceit or misrepresentation, and obtaining a prescription for opiates by giving a false name or address. The jury was evenly split between guilty and not guilty on two additional counts against Eroshevich – unlawfully prescribing a controlled substance and prescribing, administering or dispensing controlled substances to “Anna Nicole Smith, an addict.”

Stern was found not guilty of a third conspiracy count that also named the acquitted doctor, Sandeep Kapoor, 42. In addition, Stern was found not guilty of six additional counts involving obtaining and furnishing drugs for Smith. Besides the conspiracy count, Kapoor was found not guilty of another conspiracy charge and four additional counts involving furnishing the drugs.

Anna Nicole Smith is dead from drugs she was being spoon fed by these two knuckle-heads, and they take no responsibility. Not to mention her son, whom in my humble opinion was poisoned by Howard K Stern in Anna's hospital room via methadone in a go-cup, and that he held her daughter hostage from her biological father, and that he stole all of ANS's estate that he had managed to hide or get in his name. He hovered over Anna so long because he wanted his share of J Howard Marshall's estate for "attorney fees" for Mrs Marshall. As a matter of fact, now it's Stern v. Marshall.  This guy was really hanging his star on this case.

Tragic Playboy Playmate Anna Nicole Smith was investigated by the FBI over a plot to kill her tycoon husband's son, it has emerged. Newly-released files show the famously curvy blonde who was battling E Pierce Marshall over his late father's oil fortune, was probed by investigators in 2000 and 2001 over an apparent murder-for-hire plot.

According to the FBI files, a revolver was recovered from Smith's home during the investigation, as well as a three-and-a-half-inch knife. Ultimately, prosecutors decided there was not enough evidence to charge Smith, who died in 2007 from a drugs overdose.

E Pierce Marshall has also since died. During an interview with agents on July 3, 2000, "Smith began crying and denied ever making such plans," a report said. "Smith adamantly denied ever contemplating such a crime," an agent wrote. Smith's estate attorney has expressed surprise at the allegations, while representatives for Marshall's estate would not comment.

Anna Nicole Smith's FBI records, obtained by The Associated Press, say the agency investigated Smith in 2000 and 2001 in a murder-for-hire plot that targeted E. Pierce Marshall. He had long fought Smith from collecting his father's oil wealth, valued in the hundreds of millions. Pierce Marshall died three years ago of an aggressive infection.

It would be hard for this writer, to imagine Anna planning to kill him. She certainly had her vices, but was a gentle soul beneath the glitz and glamour.

In May, 2006, Anna Nicole had won a ruling by the Supreme Court that said she had a right to pursue an inheritance from the late J Howard Marshall in federal court. That was good news, she could see the fight coming to an end, but through the court, not by killing Pierce.

Anna Nicole was in South Carolina and Florida (back and forth) with Ben Thompson, Ford Shelley and his family when Pierce died in Houston, Texas on June 23, 2006. Ford had flown to California in early June, 2006 to escort her to South Carolina, where she stayed until Stern, who had stayed in California, came to fetch her in mid July, and by October the live-in lawyer and Smith were in the Bahamas on Ben's dime.

Howard does not escape my suspicion or scrutiny. By all accounts, Howard K Stern never left Anna's side and beginning in about 1996 gradually gained control of her assets, legal affairs and eventually her life. Why did that change right after the judgement from the Supreme Court?

I would really like to know where Stern was and what he was doing after Anna Nicole went to South Carolina with Ford Shelley. Especially on June 23, 2006, when E. Pierce Marshall died unexpectedly of an odd aggressive infection. He says he was working on the Supreme Court case. I do not believe him.

Now I wonder why The Associated Press requested the file. It was reportedly heavily blacked out in some areas, which gives me hope that someone in the media, law enforcement or the district attorneys office is also interested in where Stern was on June 23. We already know that he doesn't mind being "loose" with medications.

Howard K. Stern, the [blood-sucking, piss-poor attorney] companion of Anna Nicole Smith, was charged Wednesday with five more felonies stemming from the one-time Playboy Playmate's 2007 death.

The additional charges – which had already been filed against Smith's psychiatrist, Dr. Khristine Eroshevich, and her internist, Dr.Sandeep Kapoor – are four counts of obtaining fraudulent prescriptions and one count of prescribing, administering or dispensing controlled substances to an addict.

In March 2007 – roughly four weeks after Smith died in a Florida hotel room, Broward County Chief Medical Examiner Joshua Perper had asked Smith's friend and personal psychiatrist, Dr. Khristine Eroshevich, to help him tally all the drugs Smith had been taking.

Eroshevich, 61, brought with her Smith's pill bottles, and the two of them compiled a list of 44 medications – including Klonopin, Topomax, Valium, Soma and the dangerous sedative chloral hydrate. While all the drugs were for Smith, the prescriptions were made out to several different patient names, including Michelle Chase, Anne Marshall, Susie Wong, Jean Smith, Howard K. Stern, Ben Thompson, Ann Smith, and Ben Stern.

This detail is included in roughly 200 pages of search warrant affidavits released Tuesday in the case against Howard K. Stern and the two doctors...

Sadow declined to comment on what kind of physical pain Smith may have had that would justify the high volume of addictive drugs.

Eroshevich attorney Adam Braun characterized the warrants as self-serving summaries of the prosecution's allegations. He says Eroshevich was simply trying to help "her friend and patient"... (This goes so much farther back in time than the pregnancy.)

Howard K. Stern, Doctors Plead Not Guilty to Charges in Anna Nicole Drug Case

Anna Nicole Smith's lawyer and former boyfriend Howard K. Stern and two of her doctors pleaded not guilty Wednesday to charges that they helped give thousands of prescription drugs to the former Playboy Playmate in the years leading up to her fatal drug overdose in 2007.

Stern, 40, Kristine Eroshevich, 61, and another doctor, Sandeep Kapoor, 40, each face six counts including conspiracy. The commissioner granted a motion requiring each defendant to provide a handwriting sample and she scheduled a June 8 court date to determine when a preliminary hearing in the case will begin.

Each defendant faces up to five years, eight months in prison if convicted. What? That is nothing...the woman AND her son are dead!

The three defendants were each charged March 12 with three felony counts of conspiracy and several other charges of fraudulent prescriptions last month. Prosecutors said the doctors gave the drugs — including opiates and benzodiazepines — to Stern, who then gave them to Smith.
Their arraignment was previously postponded from April 7, by Superior Court Commissioner Kristi Lousteau.

California Attorney General Edmund G. Brown (ol' Gerry Brown) has called Stern Smith's "principal enabler" adding that "[Smith] took the drugs almost to the point of stupefication."

But at a press conference following court proceedings Wednesday, Stern's attorney Steve Sadow reaffirmed his belief in his client's innocence. "[Stern] didn't commit a crime, period," Sadow told reporters. "Every one of the people in this case contends that there was no crime, because in fact, there was no crime."

Sadow said he had filed a demurrer, a legal document contending that the law under which Stern is charged does not apply to him. "The statute deals with medical practitioners," he said. "He is not a doctor." Sadow previously said that Smith's prescriptions were legitimate, she was not a drug addict and that she was in control of her own life.

The medical examiner's office has said Eroshevich, a Los Angeles psychiatrist and friend of the deceased, authorized all the prescription medications found in the Hollywood, Fla., hotel room where the 39-year-old Smith was found unresponsive shortly before her death in February 2007. Eroshevich had traveled with Smith to Florida. (then flew back to L.A. just before she died.)

Eroshevich's attorney, Adam Braun, acknowledged his client wrote some of the prescriptions using fictitious names for Smith, but said that the intent wasn't to commit fraud..."It was done for privacy reasons," Braun told the AP...

Braun said Eroshevich began treating Smith following the death of the playmate's son in September 2006. The doctor traveled on several occasions over a six-month period to the Bahamas where Smith was living with Stern and wrote the prescriptions.

Brown said Eroshevich and Kapoor "violated their ethical obligations as physicians, while Mr. Stern funneled highly addictive drugs to Ms. Smith through Howard K Stern."

The criminal complaint includes eight other felony charges, including obtaining fraudulent prescriptions and unlawfully prescribing a controlled substance. In all, Stern faces six felonies and the doctors each are charged with seven...

U.S. Supreme Court Justice Anthony Kennedy rejected a request filed Monday by Stern, the executor of Anna Nicole Smith's estate, to lift a federal appellate court's stay on the $88.5 million the late star was awarded in 2002 from the $1.2 billion fortune of her late husband, Texas oil tycoon J. Howard Marshall II.

The Supreme Court determined in 2006 that the 9th U.S. Circuit Court of Appeals had overstepped its authority by wiping out the federal court judgment altogether. But the appeals court has been sitting on the award since the sudden death of Marshall's son and the family's chief anti-Anna activist, E. Pierce Marshall in June 2006, just weeks after the high court handed down its decision.

Stern's March 9 filing, arguing that Pierce Marshall's remaining assets could be gone by the time money is ordered to exchange hands, had asked to expedite the payout so that Smith's camp could "pursue Pierce's missing billions" for the benefit of her sole heir, daughter Dannielynn Hope Marshall Birkhead. (Remember, Stern went to court after Anna died to secure his 6% of the payout, $5,310,000, having acted as her attorney)

"We just sit and wait," Marshall family attorney G. Eric Brunstad Jr. told the Legal Times, when asked what the Supreme Court's decision (or lack thereof) meant for their case.

Back in March of 2008 the inquest concerning the death of Daniel Smith resulted in his death being ruled an overdose by Bahamian officials. I threw a little hissy fit and swore to never post about these people again. Now I've calmed down and the prospect that there may be actual consequences has me all excited again.

On the left side of my blog under the label "Smith" are 23 posts following the inquest, including the witness list and a readers-digest version of their testimony, in case you want to read it and refresh your memory. Current and future posts will be under specific names, not clumped under Smith.

For now, I'm just glad it hasn't been swept under the rug, and I look forward to seeing Stern do the perp walk with his hands cuffed behind his back. He really is slime.

Atty. Gen. Jerry Brown lambasted Anna Nicole Smith’s lawyer as her “principal enabler” and called the recent charges against him and two doctors alleging they illegally provided her with prescription drugs “damn serious.”

“My hope is the message will go out: Doctors do not have a license to pump innocent and often vulnerable people full of dangerous chemicals,” Brown said.

Speaking before 14 television cameras and a dozen reporters, Brown stopped short of blaming Smith’s boyfriend, Howard K. Stern, and the doctors for the 39-year-old model’s 2007 death from an accidental overdose of prescription drugs, but he said the two-year, multi-agency investigation that led to charges uncovered behavior just as troubling as “street corner” drug dealers.

“People in white smocks in pharmacies and with their medical degrees are a growing threat,” he said.

Stern and Los Angeles physicians Khristine Eroshevich and Sandeep Kapoor are charged with conspiracy to prescribe drugs to an addict as well as other counts. Authorities contend that the doctors and Stern provided Smith thousands of addictive pills, often using phony names during the three years leading up to her death. The trio face a “theoretical maximum of five to six years” in prison if convicted, L.A. County Deputy Dist. Atty. Richard Doyle said.

Stern and Kapoor turned themselves in to the Whittier Police Department on Thursday night and were freed on $20,000 bail. Eroshevich will turn herself in Monday, authorities said. They will be arraigned in Superior Court on May 13.

Her lawyer said Eroshevich, Smith’s treating psychiatrist in the final six months of her life, used pseudonyms on prescription forms to ensure the model’s privacy from a throng of media following her every move. Lawyer Adam Braun said the psychiatrist wrote prescriptions for a host of psychotropic drugs in California so she would have medical flexibility in treating Smith in the Bahamas, where she was living at the time. He said not all of the medication prescribed was made available to Smith.

Eroshevich “did the very best she could under some very difficult circumstances,” the attorney said.

Brown said the trio was motivated by a desire to be close to Smith’s money and “high life.”
“There is a certain psychic gain here to be part of the cliques of celebrity and the power,” he said.

Updated, 12:40 p.m.: A lawyer for Kapoor said the gerontologist, who practice also includes a specialty in pain management, had done nothing wrong and was charged only because of Smith's celebrity status.

"Dr. Kapoor's treatment of Anna Nicole Smith -- despite the publicity and despite the hysteria -- was medically and ethically appropriate," attorney Ellyn Garofalo said.

Stern’s attorney said he would make a statement later today.

TMZ has learned Howard K. Stern is turning himself in tonight -- he's being arrested on three felony counts for conspiracy and for allegedly illegally obtaining prescription drugs for Anna Nicole Smith.

California drug officials recently raided the Los Angeles office of Dr. Sandeep Kapoor, looking for evidence against Stern (see below). Stern has denied doing anything illegal in connection with drugs and Anna Nicole.

Law enforcement sources tell TMZ the doctor who prescribed Anna Nicole Smith methadone when she was 8 months pregnant has just had his office raided... and we've learned authorities are looking for a connection between the doc and Howard K. Stern.

The California Medical Board got a warrant to search Dr. Sandeep Kapoor's Studio City office this morning. Informed law enforcement sources tell us they are looking for prescriptions Kapoor may have written for Howard K. Stern.

We're told Medical Board officials want to know if Stern may have used Kapoor to score drugs for Anna -- something Stern has vehemently denied. The California Department of Justice, Bureau of Narcotic Enforcement, has been conducting an investigation into Kapoor since 2007.

He has also been under investigation by the Medical Board for his prescription practices. Thirteen days before Smith gave birth to Dannielynn he wrote a methadone prescription for her under an alias, Michelle Chase. Under California law, it's illegal to prescribe a controlled substance under a false name.

The raid was conducted by the DEA on behalf of the Medical Board. DEA officials took files and other documents.

Howard K. Stern just released this statement to TMZ: "Dr. Kapoor never prescribed Anna Nicole medication in my name -- and that is what the Medical Board will find out."
